A new bill in Congress wants to rip AI data centers off federal land entirely β no phase-out, no grandfather clause, just removal and site cleanup, starting within 30 days of passage. That sounds like a tech story or a land-use story. It isn’t. Strip away the legal language and what’s left is a public health story: noise that disrupts sleep, light that suppresses melatonin, smog that triggers asthma, water systems under strain, and utility bills climbing high enough to make people choose between air conditioning and groceries.
I’ve spent years watching environmental exposure show up in exam rooms long before it shows up in headlines, and this bill is a case study in exactly that. You don’t need to care about server racks to have a stake in this β you just need to live near the power lines, water pipes, or gas plants built to feed them.
What the Bill Actually Bans β and How Fast
As a doctor, I read legislation like a lab report: what does it actually change in the body? The No AI Data Centers on Federal Lands Act, introduced by Rep. Tlaib on July 23, 2026, reads like an infrastructure bill, but every provision maps back to air quality, water supply, and utility bills. Keep that lens as we walk through what it does.
This is a flat prohibition, not a moratorium. Construction or operation of an AI data center or its associated infrastructure on federal land is banned outright, and any agency currently operating, leasing, building, or constructing one has to remove it β no grandfather clause, no phase-out. Within 30 days of enactment, agencies must stop operations or construction and begin removal.
Removal has to follow the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 β the Superfund law β including natural resource restoration. Lawmakers are treating these sites like contaminated industrial land, not empty office space.
The definition of “AI data center” closes loopholes. A facility qualifies if it develops or runs AI models at scale, or clears technical thresholds: over 20 megawatts of power capacity, 20+ kilowatts to a single server rack, or liquid cooling systems β the same setups that pull hard on local water supply.
“Associated infrastructure” is defined broadly too: transmission lines, substations, natural gas plants and pipelines, backup generators, and water or cooling systems. The ban reaches the power and water infrastructure feeding these buildings β exactly what drives local air quality, water strain, and grid costs.
Federal land covers everything the U.S. owns or manages, including Department of Defense land, so military bases and their surrounding communities are included. Tribal trust land is excluded.
The Health Case Against Data Centers on Public Land
Tlaib, co-founder of the People’s Environmental Justice Caucus, says AI data centers bring noise, light, air, and water pollution, and can increase energy costs by as much as 267%. Break that into four separate exposures, because they don’t act on the body the same way.
Tlaib frames her opposition to these facilities around health exposure, not abstract policy, and the reasoning holds up clinically.
Noise pollution from data center cooling fans runs low-frequency and constant β the kind that raises cortisol and disrupts sleep architecture even when people don’t consciously register it as loud. Light pollution from round-the-clock facility lighting suppresses melatonin production in nearby residents, a documented driver of poor sleep quality. Air pollution is the most direct hit: these facilities often lean on backup natural gas generation, and Tlaib describes residents near existing sites as “choking on smog” β smog exposure is tied to asthma flare-ups, cardiovascular strain, and reduced lung function over time. Water pollution and water stress compound it, since the liquid cooling systems from Section 1 pull heavily from local supply, tightening it for everyone else on the grid.
Then there’s the cost side, which is a health issue even though it doesn’t look like one. Energy costs near these facilities can climb by up to 267%. When utility bills spike that hard, patients on fixed incomes cut corners β skipping air conditioning during heat waves, underusing heat in winter, or rationing refrigeration for temperature-sensitive medications like insulin. That’s not hypothetical; it’s a known pathway from energy poverty to preventable ER visits.
The Regulatory Moves Behind the Urgency
This bill isn’t reacting to a slow-moving trend. It’s responding to several fast regulatory and procurement moves that stacked up over just a few months in 2026, and each one removed a safeguard patients would otherwise rely on.
In May, the Department of Defense asked for close to $30 billion to build large-scale data centers running AI hardware and software that hasn’t been fully vetted, systems intended to factor into military decisions with life-or-death stakes. Many of these facilities would sit on bases, meaning military families living nearby would absorb the same noise, light, and air exposure any neighboring community faces β without having asked for it.
The bigger regulatory shift: a new rule from the Trump administration lets these data centers skip Clean Air Act permits entirely. That permit process is the actual screening mechanism β the step where air quality gets reviewed before a facility starts operating, not after residents start reporting symptoms. Removing it doesn’t just speed up construction; it removes the checkpoint where pollution risk normally gets caught early.Β
Then there’s process itself: the Bureau of Land Management recently approved the first data center built on BLM land, located in Nevada, without any public input. Communities never got the chance to raise health concerns before ground broke.
And this isn’t isolated. Separately, the Department of Energy has identified as many as 16 federal sites nationwide as candidates for AI data center development. Tlaib’s bill is a direct response to that pace: a blanket ban is what happens when site-by-site pushback can’t keep up with how fast these approvals are moving.
Who’s Standing Behind the Bill
Tlaib isn’t carrying this alone. Five House colleagues signed on as cosponsors: Jim McGovern, Adelita Grijalva, Delia Ramirez, Mark Pocan, and Bonnie Watson Coleman. Four advocacy organizations backed it too β Center for Biological Diversity, Climate Justice Alliance, Food & Water Watch, and Win Without War.
What stands out, from where I sit, is how consistently these groups frame their support around health, not just land use or policy. Camden Weber of the Center for Biological Diversity argued that public lands belong to communities, not to the tech industry’s bottom line, and that this bill holds the industry accountable for the air, water, and habitat all species rely on. Mar Zepeda Salazar of Climate Justice Alliance made the health connection explicit, saying the bill sets a guardrail so the AI buildout doesn’t come at the cost of public health, environment, or community voice. Health isn’t implied here β it’s named directly.Β
Jim Walsh of Food & Water Watch tied it to protecting communities’ air, water, health, and financial stability from what he called an exploitative industry β financial stability sitting right next to health, which tracks with the energy-cost burden discussed earlier.
And Shayna Lewis of Win Without War warned that public lands shouldn’t become dumping grounds for the costs of the AI race β the energy, water, pollution, and infrastructure burdens that would otherwise land on nearby communities.
